Debs,

Sorry but i cannot agree with your implication that "by the time it becomes public knowledge the deal is done".

I would refer you to the WT report for Nov 2008 (14 months ago!)

http://www.wiltshiretimes.co.uk/news/3867813.Mum_s_A350_crossing_appeal/

As reported in that story, other consultations had previously occurred (when the Town Council asked for a further crossing on Warminster Road, some 2 years ago) and County Engineers could not find a suitable location - probably stalling in the hope the bypass would have been built and traffic volumes reduced.

However, they have now come up with a solution and announced it (a decision that some will like, others will not). I think Mike C-M, as Unitary Councillor for that area, did well to keep the pressure up - that is what he was elected to do.

Maybe others would like to stand for council as im sure there will be a by-election in the near future.

I am not suggesting I could do any better as a councillor, just highlighted that quitting a forum because someone disagrees with you is a bit extreme.

and to paste a private message is totally wrong and rude as private messages are just that private, a warning in future for anyone dont send him any messages as he will copy and paste

Like you tried to do here Mike (Page 2 second post from the bottom). Maybe you should warn people about sending you PM's also. Practice what you preach springs to mind.

Dont you dare suggest ive posted a private message shizzy, if I ever had done it would have been with the consent of the sender, what you are talking about is a load of bollocks .perhaps you want to read carefully again before spurting utter rudeness and to be honest I feel very sorry for you it must be so sad living your life as it is with nothing better to do then sit there attacking people for your own gratification.

Just to clarify ....

It was not Mike C-M who posted a copy of his private mesage to someone (Tony).

It was Tony who, without permission (ie. in full breach of copyright) posted the whole private mesage to him from Mike C-M up on the other forum.

Then Pat copied it here.

Then someone criticised Mike C-M for publishing to the world his own private message, when he had not.

In the meantime, the other forum has removed the original post so no-one can now read it there.

It is the copy here (put up by Pat) that now needs to be removed.

  • Right here, right now.
Why does it need to be removed? Neither party has asked for it to be and its not, despite what you say Baldy, in breach of any copyright.

i agree Russell you are spot on. Copyright is a complex matter to try and symplify it: if any written word, plan or sketch is duplicated without the authors permission its in breach of copyright that is not to be confused with a patent which is a different kettle of fish.   Hope this helps.

Not if the author publishes it in certain ways... Still, neither party has asked for anything to be removed so this is a moot point ATM.

The author didnt ask as far as im aware for this to be reproduced, it was a private message that a 3rd party chose to publish.

Not really. Its been proved by the UK legal system that sending an email is as good as public publishing. A PM system would be, I suggest, no different.

There are situations when copyrighted material can be used without breaching copyright - eg. quoting parts only, research etc.

I assure you Al, any private letter or text message is copyright material unless the author has given permission for its publication.

It is not a criminal offence, but the copyright owner can sue for its use to be stopped and for any damages.

There may also be the matter of breach of trust if an understanding existed (expressed or implied) that PMs remain private.  In a Cllrs case, that could be a serious breach of the code of conduct to publish private correspondence (unless there is a public interest defence). This could have other consequences for anyone holding other public positions .....

I think there is a misunderstanding here.

Sending any correspondence, whether by email or not, is a form of publishing. What matters in the current context is that the correspondence has moved out of private circulation into the  public domain (the chat forum) - ie. unrestricted circulation.

fair comment, then surely a breach of trust or confidentiality may be considered especially as its a private message on a 1 to 1 basis IE. not for general publication.

Wow, talk about threads veering way off topic...

I welcome the siting of the new pedestrian crossing, it will be much easier for kids to cross the road when going from Matravers to the Sports Centre and vice versa. I think a crossing by Hospital Road will be too close to any traffic lights or whatever will be installed for the new Aldi store (if it ever gets built).
