first wiltshire man jailed for breach of domestic violence abuse

The 35-year-old was jailed for 28 days by Salisbury magistrates on Wednesday after three breaches of an order over Christmas and New Year.
The man, who lives in the Salisbury area, is the first to be imprisoned for breaching an order since the Home Office pilot started in July 2011.
He was issued with a Domestic Violence Protection Notice (DVPN) while in custody on December 13.
Two days later, Salisbury magistrates issued a 28-day DVPO in his absence.
Under the order, he was banned from molesting his partner, entering an address in the Salisbury area or going within 100 metres of the property.
In the early hours of Christmas Eve, officers arrested the man at the address for breaching the order.
He appeared before magistrates in Chippenham and claimed to be unaware of the order. The court dismissed the breach. Before he left court, the DVPO was served on him.
Later on Christmas Eve, he was again arrested at the address for breaching the order and taken into custody in Salisbury.
On Boxing Day he appeared before magistrates in Chippenham, admitted the breach and was fined £50 which the court decided had been paid in lieu because of the time spent in custody. He was reminded to abide by the DVPO.
On December 29, officers again arrested the man at the property. The next day he appeared before Chippenham magistrates and was fined £50 plus costs and advised that the court would not be so lenient if he breached the DVPO again.
On Tuesday evening police responded to a 999 call from a child at the address. The man was arrested. On Wednesday Salisbury magistrates jailed him for 28 days.
Acting Detective Chief Inspector Lisette Harvey said: "We have been given new powers to improve the safety of victims of domestic abuse, and we are making full use of those powers.
"We made it clear when the pilot began in the summer that we would deal swiftly and robustly with any attempted breaches.
"This case demonstrates very clearly that domestic abuse will not be tolerated in our county and that we will take firm action to ensure that perpetrators abide by the terms of DVPNs and DVPOs."
How the process works When officers are called to a domestic abuse incident, their priority is to ensure that everyone at the address is safe. Some officers are now equipped with body-worn video cameras to record the scene.
Sometimes there may not be enough evidence to charge the perpetrator with a criminal offence.
But if, on the balance of probabilities, a superintendent feels the victim is at risk of further violence, he or she can authorise a Domestic Violence Protection Notice (DVPN).
A DVPN excludes the perpetrator from the address, or from approaching or molesting the victim, for 48 hours. Officers then seek a Domestic Violence Protection Order (DVPO) from magistrates. DVPOs can be issued for 14, 21 or 28 days.
Eighty two people had received DVPOs in Wiltshire and Swindon by the end of November 2011.
Two other forces, Greater Manchester and West Mercia, are taking part in the pilot which will be evaluated by the Home Office before it decides whether to seek a change in the law.
Several perpetrators in Greater Manchester have been jailed for breaching their orders.

im glad to see this is being used to its potential. lets hope a lot more women are helped with this new law....and yes men too
seems he had his chance by only spending a night in jail in lieu of a £50 fine which he refused to take as a chance and still returned to the property after being warned what would happen if he did. GOOD...its about time the courts and police did what they say they were going to do. i know domestic violence is complicated because there is often children to be considered and the fact the man promises to change and not do it any more and of course the woman will drop charges because the still loves him . hopefully now with this new power people in this situation can be helped to either stop it or get out of the situation. these days there is more help and people are more readily able to talk about it. its about time certain people realised that their partners/wives/ husbands etc arent punchbags when things spiral out of control and they cant control their temper.
